Terms and Conditions of Tracking Service Rental

Sinister Sports Inc. (SSI) is providing a tracking service for adventurers to help them stay connected with family and friends. By contracting this service, the renter agrees to the following terms and conditions. 

1. A security deposit is required to use this service and obtain rental equipment from SSI. 
2. The rental period begins on the date the rental equipment is delivered to the renter. 
3. The renter agrees to return all equipment to SSI within the rental period specified in their order. If the rented equipment is not returned on time, an additional fee of $40 per day, per item, will be charged. If the item is not returned after seven days, SSI will keep the security deposit in its entirety, in addition to the additional per-day fee.
4. The user agrees to pay for any additional charges incurred due to the use of the rental device software, including but not limited to text messaging, or weather updates, and track points. 
5. If the equipment is not returned in the same condition, and the unit is not fully serviceable, SSI will keep the security deposit in order to replace the damaged item(s). If the device is serviceable but damaged, SSI will undertake repairs and deduct the appropriate amount from the security deposit, however, SSI has the right, at its sole discretion, to replace the equipment if required. 
6. The equipment provided will be fully charged when it is delivered to the renter. SSI is not responsible for equipment failures in the field, such as loss of power, depleted batteries, inability to send messages due to software issues, or the inability of a tracking device to locate satellites.
7. The renter is solely responsible for the safe storage, usage, and return of any rental equipment. The renter assumes all responsibility for loss or damage to all rental equipment. 
8. The tracking service is not a replacement for good planning, and it is the sole responsibility of the renter to ensure that they have planned appropriate routes and trips that are in line with their abilities. 
9. SSI is not responsible for tracking the whereabouts of the renter. The renter should use this equipment to contact the appropriate resources in the event of an emergency. 
10. The renter will indemnify and hold harmless SSI against all claims, actions, suits, proceedings, costs, expenses, damage and liabilities, including attorney fees and costs, arising out of or related to the renter’s use of the rental equipment.
